The following Terms and Conditions (these “Terms and Conditions”) govern the use of this website (the “Site”) and rules by which members of the Starwood Preferred Guest® program (“SPG Program”), Marriott Rewards® Program (“Marriott Rewards Program”) and The Ritz-Carlton Rewards® Program (“Ritz-Carlton Rewards Program”) may link their individual SPG Program member account with their individual Marriott Rewards Program member account or their individual Ritz-Carlton Rewards Program member account (each, a “Linked Member”, and collectively, the “Linked Members“). For purposes of these Terms and Conditions, (i) the SPG Program, the Marriott Rewards Program and The Ritz-Carlton Rewards Program will be collectively referred to as the “Programs” and individually referred to as a “Program” and (ii) the Marriott Rewards Program and The Ritz-Carlton Rewards Program will be collectively referred to as the “Rewards Programs” and individually referred to as a “Rewards Program”. The SPG Program is operated by Preferred Guest, Inc., Starwood Hotels & Resorts Worldwide, LLC and their affiliates (collectively, “SPG”). The Rewards Programs are operated by Marriott International, Inc. (“Marriott”) and The Ritz-Carlton Hotel Company, L.L.C. (“Ritz-Carlton”) and their affiliates.

By agreeing to link his or her SPG Program member account and his or her Rewards Program member account, each Linked Member agrees that he or she has read, understood and accepted these Terms and Conditions. SPG, Marriott and Ritz-Carlton (collectively, the “Operators”) may at any time amend, modify or supplement these Terms and Conditions, and continued use of this Site or participation in the opportunity made available by the Operators to link Program accounts will constitute a Linked Member’s acceptance of any such amendment, modification, or supplementation.

To the extent that terms are capitalized in Terms and Conditions and are not otherwise defined, the terms have the meanings specified in (i) the terms and conditions of the SPG Program, which can be found at www.spg.com/terms (the “SPG Terms”) to the extent such terms related to the SPG Program and the benefits and services provided thereunder and (ii) the terms and conditions of the Rewards Programs, which can be found at https://www.marriott.com/rewards/terms/default.mi (the “Rewards Program Rules”) to the extent such terms related to the Rewards Programs and the benefits and services provided thereunder. In the event there are any conflicts between these Terms and Conditions and the terms contained in the SPG Terms or Rewards Program Rules, the terms in the SPG Terms or Rewards Program Rules will govern.

Linking Member Accounts

  1. Eligibility. To link an SPG Program member account and a Rewards Program member account, an individual must have an active membership in both the SPG Program and a Rewards Program and the member accounts in each of the applicable Programs must be registered under the same name. Membership into the Programs may be obtained for free at www.spg.com, www.marriott.com and www.ritzcarlton.com.
  2. Linking. An individual may link his or her Rewards Program and his or her SPG Program member account at www.marriott.com, www.ritzcarlton.com or www.spg.com. Linking accounts and transferring points by phone are not available.
  3. Effect of Linking. Linking Program accounts does not merge the Linked Member’s accounts or create one single account. Any benefits accrued in the Linked Member’s respective Program accounts (such as nights or points previously earned) will remain separate except as provided in these Terms and Conditions.
  4. Duplicate Accounts. An individual will only be able to link a single Rewards Program member account with a single SPG Program member account. If an individual has multiple member accounts in the Rewards Program or SPG Program, the individual must merge the applicable accounts in such Program as permitted under the applicable Program rules in order to link all of those accounts with his or her member accounts in the applicable other Program.
  5. Member Account Activity. Linking an SPG Program member account and a Rewards Program member account (i) will constitute activity for purposes of remaining active in the SPG Program, and (ii) will not count as qualified activity for purposes of keeping your points active in the Rewards Program. Please see the terms and conditions governing account activity and points expiration for Rewards Program and SPG Program.
  6. Terms of the Individual Programs. Unless otherwise specified in these Terms and Conditions, (i) the Rewards Program Rules will continue to apply to a Linked Member’s Rewards Program member account and any and all benefits and activity thereunder, and (ii) the SPG Terms will continue to apply to a Linked Member’s SPG Program member account and any and all benefits and activity thereunder.

Unlinking. A Linked Member may unlink his or her member accounts at any time by calling (SPG) 1-888-625-4988, (Marriott Rewards)  1-801-468-4000, or (The Ritz-Carlton Rewards) 1-866-922-6882, and the accounts will be unlinked within 48 hours of the Operators’ receipt of such request. Global contact information for customer care can be found at: http://www.starwoodhotels.com/preferredguest/support/index.html, www.marriott.com/help/rewards-customer-support.mi, or www.ritzcarlton.com/en/rewards/guest-services Any benefits that were being provided pursuant to these Terms and Conditions would be forfeited (including status matching) as of the time that the accounts are unlinked.

Transfer of Points

  1. Transfer Eligibility. At any time after having linked Program member accounts, a Linked Member may transfer (i) Starpoints® from his or her SPG Program member account into either Marriott Rewards Points or The Ritz-Carlton Rewards Points (collectively, “Rewards Points“) to be deposited into his or her linked Rewards Program member account, or (ii) Rewards Points from their Rewards Program member account into Starpoints to be deposited into his or her linked SPG Program member account. Starpoints or Rewards Points may only be transferred to a Program member account that is linked to the account from where the Starpoints or Rewards Points originate. Starpoints earned through an interest in a Vistana™ Signature Experiences property, and Rewards Points earned through an interest in a Marriott Vacation Club® property cannot be transferred between the Programs.
  2. Transfer Amounts. Linked Members may transfer any amount of Rewards Points into Starpoints or Starpoints into Rewards Points in increments of 1,000 points as long as such amount of Rewards Points or Starpoints, as applicable, is currently available in their applicable Program member account as of the time of transfer. In the event that any transfer of Rewards Points into Starpoints results in a partial Starpoint, the number of Starpoints will be rounded down to the nearest full Starpoint. For example, if a Linked Member transfers 1,000 Rewards Points into Starpoints, his or her SPG Program member account will be credited with 333 Starpoints.
  3. Transfer Exchange Rate.
    1. 3 Rewards Points will equal 1 Starpoint when transferred by a Linked Member between linked Program member accounts.
    2. 1 Starpoint will equal 3 Rewards Points when transferred by a Linked Member between linked Program member accounts.
  4. Timing of Transfers. Transfers of Starpoints or Rewards Points will be effective immediately upon the execution of the transfer. Once the transfer is executed and effective, any Starpoints or Rewards Points deposited in a Program member account will then be subject to the terms and conditions of the Program into which such Starpoints or Rewards Points were transferred, including with respect to the use of such points with third-party partners. For clarity, if Starpoints are transferred into Rewards Points, as soon as the transaction to transfer such Starpoints is executed, the Starpoints being transferred will be considered to be Rewards Points and will be subject to the Rewards Program Rules. Once a transfer transaction is completed, the transaction cannot be reversed, although the Linking Member may subsequently transfer points back to the originating account.
  5. Member Account Activity. Transferring points between Programs (i) will constitute activity for purposes of remaining active in the SPG Program, and (ii) will not count as qualified activity for purposes of keeping your points active in the Rewards Program. Please see the terms and conditions governing account activity and points expiration for SPG Program and Rewards Program.

Status Match

  1. Status Match Eligibility. At any time at or after having linked his or her applicable Program member accounts, if a Linked Member has Elite Preferred Guest Membership Status (as defined in the SPG Terms) in the SPG Program or has Elite memberships status in the Elite Membership Program (as defined in the Rewards Program Rules) of the Rewards Program, the Operators will match his or her highest elite membership status, if applicable, as follows:
    1. If a Linked Member has achieved a higher elite membership status in the SPG Program than in a Rewards Program, the Linked Member will receive matched status in Marriott’s Elite Membership Program as set forth in the below chart:
      If a Linked Member has the following Elite Preferred Guest Membership Status in the SPG Program: The matched status in Rewards’ Elite Membership Program will be:
      Platinum Preferred Guest Platinum
      Gold Preferred Guest Gold
      Preferred Plus* Guest Silver
      Preferred Guest Member

      *”SPG Preferred Plus” refers to SPG Members who have one of the following associated with their SPG Program member account:  (i) an American Express SPG co-branded credit card, (ii) an auto club membership or (iii) an AARP membership. 

    2. If a Linked Member has achieved a higher elite membership status in a Rewards Program than in the SPG Program, the Linked Member will receive matched status in the SPG Program as set forth in the below chart:
      If a Linked Member has the following status in Rewards’ Elite Membership Program: The matched Elite Preferred Guest Membership Status in the SPG Program will be:
      Platinum Platinum Preferred Guest
      Gold Gold Preferred Guest
      Silver Preferred Plus Guest
      Member Preferred Guest
  2. Timing of Status Matching. Updated elite membership status will become effective (i) immediately after Program accounts are linked or (ii) within 24 hours after a new elite membership status in one of the Programs (whether an increase in status or a decrease in status) is reflected in his or her Rewards Program member account or SPG Program member account.
  3. Benefits.
    1. SPG Program. During a Stay at an SPG Participating Hotel (each as defined in the SPG Terms), a Linked Member will be eligible to receive the benefits associated with his or her Elite Preferred Guest
      Membership Status in the SPG Program pursuant to the SPG Terms, and will not receive any benefits provided to elite members pursuant to the Rewards Program Rules. A Linked Member will only receive any such benefits that are earned as a result
      of status matching pursuant to these Terms and Conditions for Stays at an SPG Participating Hotel where the arrival for such Stay occurs after the Linked Member has linked his or her SPG Program member account with his or her Rewards Program
      member account.
    2. Rewards Programs. While staying at a hotel that participates in the Rewards Programs, a Linked Member will be eligible to receive the benefits associated with his or her status in Rewards’ Elite
      Membership Program pursuant to the Rewards Program Rules, and will not receive any benefits provided to elite members pursuant to the SPG Terms. A Linked Member will only receive any such benefits that are earned as a result of status matching
      provided pursuant to these Terms and Conditions for stays at a hotel participating in the Rewards Programs where the arrival for such stay occurs after the Linked Member has linked his or her SPG Program member account with his or her Rewards
      Program member account.
  4. Temporary Promotional Status Benefits. In the event that a Linked Member has received a temporary promotional status upgrade in connection with a Program (for example, Rewards’ “Taste of Gold” promotion), the promotional status upgrade will not be considered when determining matched status pursuant to these Terms and Conditions.
  5. Lifetime Status.
    1. SPG Program.
      1. Any lifetime benefits provided pursuant to the SPG Terms, such as SPG Lifetime Gold Status (as defined in the SPG Terms) or SPG Lifetime Platinum Status (as defined in the SPG Terms), will not apply to the Linked Member’s Rewards Program account, although the underlying Elite status of the Linked Member will be matched in the Rewards Program pursuant to these Terms and Conditions.
      2. Any full calendar year in which a Linked Member has his or her Elite Preferred Guest Membership Status upgraded as the result of the status matching benefits provided pursuant to these Terms and Conditions will qualify as an Eligible Status Year (as defined in the SPG Terms) pursuant to the SPG Terms for purposes of an SPG Member earning SPG Lifetime Gold Status or SPG Lifetime Platinum Status.
    2. Rewards Programs. Any lifetime benefits provided pursuant to the Rewards Program Rules, such as Lifetime Silver, Lifetime Gold and Lifetime Platinum status, will not apply to the Linked Member’s SPG Program account, although the underlying Elite status of the Linked Member will be matched in SPG Program pursuant to these Terms and Conditions.
  6. Expiration of Status Matching. In the event that a Linked Member has his or her Elite Preferred Guest Membership Status or his or her status in Rewards’ Elite Membership Program upgraded as a result of the status matching benefits pursuant to these Terms and Conditions, his or her Elite Preferred Guest Membership Status or his or her status in Rewards’ Elite Membership Program will continue to be upgraded until the date that (i) the Linked Member’s participation in such benefits are terminated pursuant to these Terms and Conditions, or (ii) the Linked Member no longer has the Elite Preferred Guest Membership Status or the status in Rewards’ Elite Membership Program that originally provided the status matching benefits (for example, if a Linked Member was a Gold Preferred Guest and his or her Gold Preferred status expires on February , 2017 pursuant to the SPG Terms, he or she will be a Gold member in the Elite Membership Program only through February, 2017 unless he or she independently qualified to be a Gold member pursuant to the Rewards Terms).

Termination

  1. A Linked Member may terminate his or her participation in the benefits at any time by unlinking his or her SPG Program member account with his or her Rewards Program member account.
  2. The Operators may suspend a Linked Member’s benefits, reverse any benefits or terminate a Linked Member’s ability to participate in the benefit set forth in these Terms and Conditions at any time with immediate effect and without written notice, for any reason and in their sole discretion including, without limitation, if:
    1. Any of the Linked Member’s Program member accounts has been suspended or terminated for any reason;
    2. The Linked Member no longer has active membership in both the SPG Program and a Rewards Program; or
    3. The Operators believe the Linked Member has:
      1. Breached or violated these Terms and Conditions, the SPG Terms or the Rewards Program Rules;
      2. Acted in a manner inconsistent with applicable laws, regulations, ordinances;
      3. Failed to pay any hotel bill when due to an Operator or an SPG Participating Hotel or a hotel participating in a Rewards Program;
      4. Acted in an inappropriate, fraudulent, abusive or hostile manner; or
      5. Engaged in any misconduct or wrongdoing in connection with these Terms and Conditions or the benefits provided hereunder.

Miscellaneous

  1. Modification. The Operators may change these Terms and Conditions at any time, for any reason and without notice.
  2. Termination. The Operators may terminate any or all of the benefits provided under these Terms and Conditions at any time. A Linked Member may not claim any such benefits after any such termination.
  3. Benefits Subject to Availability and Modification. All benefits, amenities, offers, awards and services provided pursuant to these Terms and Conditions are subject to availability and may be changed at any time without notice.
  4. No Sale or Transfer. The benefits provided pursuant to these Terms and Conditions may not be sold, bartered or transferred (other than by an Operator or their respective agents). Any attempted transfer, sale or barter will be void. The Operators and their partners may refuse to honor or recognize any benefits which such party believes may have been transferred, sold or bartered.
  5. Member Data. The Operators may each receive data regarding Members from the other parties including, without limitation, names, addresses, email addresses, SPG Program member account information and Rewards Program member account information.
    1. Marriott and Ritz-Carlton. Marriott and Ritz-Carlton may receive data regarding Linked Members from SPG which may be used by Marriott and Ritz-Carlton in connection with these Terms and Conditions including, without limitation, to verify account information and provide benefits. The data provided to Marriott and Ritz-Carlton from SPG may include a Linked Member’s name, email address, and SPG Program member account number and will be used by Marriott and Ritz-Carlton in accordance with Marriott’s Privacy Policy.
    2. SPG. SPG may receive data regarding Linked Members from Marriott or Ritz-Carlton which may be used by SPG in connection with these Terms and Conditions including, without limitation, to verify account information and provide benefits. The data provided to SPG from Marriott or Ritz-Carlton may include a Linked Member’s name, email address, Rewards Program member account number and will be used by SPG in accordance with SPG’s Privacy Statement.
  6. No Warranties or Representations, Express or Implied. The Operators make no warranties or representations, either expressed or implied with respect to type, quality or fitness of goods or services provided pursuant to these Terms and Conditions.
  7. Indemnification. You agree to indemnify and hold the Operators, the SPG Participating Hotels, hotels participating in the Rewards Programs and their respective subsidiaries, affiliates, officers, directors, agents and employees harmless from any claim or demand, including reasonable attorney’s fees, made by any third party due to or arising out of your breach of these Terms and Conditions or your violation of any law or the rights of a third party.
  8. Waiver. Waiver of any breach of these Terms and Conditions by any Member will not constitute a waiver of any other prior or subsequent breach of these Terms and Conditions.
  9. Limitation of Liability. IN NO EVENT WILL AN OPERATOR, ANY SPG PARTICIPATING HOTEL OR ANY HOTEL PARTICIPATING IN THE REWARDS PROGRAMS BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, EXEMPLARY, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY KIND, WHETHER BASED IN CONTRACT, TORT OR OTHERWISE, WHICH ARISE OUT OF OR ARE IN ANY WAY CONNECTED WITH THE BENEFITS PROVIDED PURSUANT TO THESE TERMS AND CONDITIONS OR THESE TERMS AND CONDITIONS.
  10. Choice of Law and Venue. Any disputes arising out of or related to the benefits provided pursuant to these Terms and Conditions or these Terms and Conditions will be handled individually without any class action, and will be governed by, construed and enforced in accordance with the laws of the State of New York, United States, without regard to its conflicts of law rules. The exclusive jurisdiction for any claim or action arising out of or relating to these Terms and Conditions may be filed only in the state or federal courts located in the State of New York, United States.
  11. Trademarks. Starpoints, SPG, Preferred Guest, and their respective logos are the trademarks of SPG. Marriott and Ritz-Carlton are the trademarks of Marriott International, Inc.
